Returns & Cancellations

Faulty products

We will replace or refund you for any bottle of wine that is damaged, flawed or that the customer finds unsatisfactory. We ask the customer to return the unfinished portion of the original bottle for replacement. By law, we cannot accept returns of alcoholic beverages unless the product is corked or flawed.

For some high value products, My Smart Cellar reserves the right to have the product assessed for acceptable quality prior to discussing a suitable remedy with you.

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the products repaired or replaced if the products fail to be of acceptable quality and the failure does not amount to a major failure.

In addition to a Buyer's rights under the Australian Consumer Law, if within 28 days of the date of dispatch from My Smart Cellar premises of any Goods

·        My Smart Cellar receives notice in writing from a Buyer that, in their view, the Goods were short or ullaged at the time of the sale and that the goods were not so described on the website; and

·        Within fourteen days of such notice, the Goods are returned to My Smart Cellar in the same condition (as reasonably determined by My Smart Cellar) as at the date of the purchase (as applicable); and

·        The Buyer satisfies My Smart Cellar that the Goods were not correctly described as specified in paragraph (a) and the Buyer is able to transfer good title to the Goods; and

·        My Smart Cellar is satisfied that the product is materially different to the description,

·        My Smart Cellar may set aside the sale and either replace or refund to the Buyer (at My Smart Cellar's discretion) the amount paid by the Buyer in respect of the Goods.

·        These undertakings do not apply to wines older than 15 years.

·        A Buyer shall not be entitled to claim for more than the amount paid by the Buyer for the goods and, in particular, shall have no claim for any other loss or damage, whether direct or indirect, suffered by the Buyer.

 

 

We are also unable to accept return of wine that was damaged due to adverse weather conditions during shipment, or wine that is ordered in error. Please send an email to josh@mysmartcellar.com to arrange for the return of corked or flawed product.

Once the wine is received, we will refund your credit card account for the cost of the wine less shipping and handling. If the original shipment was damaged or flawed you will receive a full refund, including shipping and handling charges for that portion of the order.

●      We will ask you for a valid proof of purchase when returning a faulty product.

 

Defective services

In respect to any other services My Smart Cellar provides, our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

●      to cancel your service contract with us; and

●      to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to be compensated for any other reasonably foreseeable loss or damage.

 

If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.

 

Change of mind return

My Smart Cellar happily gives you a refund or an exchange if you have changed your mind on a purchase, provided that the product is:

●      returned within 90 days after it has been purchased.

●      not opened or damaged, and in a re-saleable condition.

●      still in its original packaging (eg. when the product was sold in a carton, the carton must be unopened)

●      evidence that the wine has been stored in appropriately during that time, and storage has not led to any spoiling of the wine

 

Please note that the delivery fee incurred will not be refunded if a purchase is returned as part of the change of mind policy.  Also, a 15% restocking fee will be applied to all cancelled orders.
